Surrogates are a tremendous help to parents who are unable to birth children traditionally. For both surrogates and parents, however, it is important to understand the legal risks that arise during surrogacy.

Like many other states, Minnesota does not yet have specific surrogacy laws. Even so, surrogate parents will need to take specific steps to be legally established as the child’s parents. Similarly, surrogates themselves need a lawyer to protect their legal rights during a surrogate contract agreement. Without a solid plan and framework in place, surrogates and parents-to-be may find their legal rights are not adequately protected.
